Italian civil law is a codified system based on statutes where judges apply written laws, leaving little room for precedent. Common law, used in countries like the UK and US, relies heavily on judicial decisions, case law, and precedent. In civil law, statutes dominate; in common law, courts shape the law through interpretation and rulings.
To stay in Italy beyond 90 days, you must apply for a National Type D visa (work, study, family, retirement, etc.) before entry. Within 8 days of arrival, apply for a residence permit (permesso di soggiorno) at the local Questura. Requirements vary by purpose but typically include proof of income, housing, insurance, and valid documents.
While not legally required, hiring a lawyer to purchase property in Italy is highly recommended. They ensure due diligence, verify ownership, check for liens or debts, review contracts, and protect your interests. Transactions are notarized, but a lawyer provides added security, especially for foreign buyers unfamiliar with Italian property law.
In Italy, child custody is governed by the principle of the child’s best interests. Parents usually share joint custody (affido condiviso), ensuring both play active roles in upbringing. Sole custody may be granted if one parent is deemed unfit. Decisions on residence, education, and support are court-supervised, with child welfare as the priority.
To start a business in Italy, you must choose a legal form (e.g., SRL, SPA, sole proprietorship), register with the Companies Register (Registro delle Imprese), obtain a tax code and VAT number, and enroll with social security and insurance. Certain sectors need special licenses. Compliance with labor, tax, and local regulations is mandatory.
In Italy, a lawyer (avvocato) represents clients in court, provides legal advice, and drafts contracts. A notary (notaio) is a public official who authenticates and registers deeds, property transfers, wills, and corporate acts. Lawyers defend and advise, while notaries ensure documents are valid, enforceable, and comply with Italian law.
Property buyers in Italy pay registration tax (2% if main residence, 9% otherwise), or VAT if buying new. Mortgage and cadastral taxes also apply. Closing costs include notary fees (1–2.5%), legal fees if used, and agency commission (2–4%). Annual IMU tax applies on second homes. Costs vary by property type, value, and buyer status.
Italian citizenship by descent (jure sanguinis) is available if you have an Italian ancestor who did not renounce citizenship before their child’s birth. You must prove lineage with birth, marriage, and naturalization records. Applications are filed at an Italian consulate or in Italy. No generational limit applies, but rules differ for maternal lines before 1948.
Forced heirship in Italy (successione necessaria) reserves a portion of your estate for close relatives—spouse, children, and sometimes parents—regardless of your will. You cannot freely dispose of your entire estate; heirs are entitled by law to their reserved shares. Any will conflicting with these rights may be reduced by the court to protect forced heirs.
